LEGAL AID FOR PERSONS SEEKING A STATUS OF “BENEFICIARY OF SUPPORT”

One of the important functions of the Legal Aid Service is to provide legal services on issues related to obtaining guardianship.

The Legal Aid Service provides free legal counselling to beneficiaries to protect their rights. They may benefit from person-to-person and telephone/online consultation services. In civil proceedings mandatory defense is applied to only those cases when the court acknowledges a person as a receiver of guardianship and appoints a guardian.  A lawyer’s assistance is provided despite the person’s solvency and socioeconomic status.

A person is acknowledged as a receiver of guardianship if he/she has persistent psychic and mental/intellectual problems, precluding him/her from the full and effective engagement in public life equally with other persons.

An application for acknowledging a person as a receiver of guardianship and appointing  a guardian may be submitted by the person himself/herself, his/her family member, his/her legal representative, a guardianship and care agency, a psychiatric or specialized institution.

 A person considered for receiving guardianship, has a right to:

  • benefit from a lawyer’s services at the State’s expense;
  • attend court proceedings and participate in a trial;
  • if he/she is unable to attend a court proceeding, to request participation in a trial through electronic and other means of communication;
  • have a desirable guardian;
  • appeal a court decision by the deadline established in the law;
  • apply to a court and request to change a guardian if this request is justified.   

LEPL - Legal Aid Service provides court representation to persons receiving guardianship in civil and administrative cases, despite their solvency and socioeconomic status, starting from April 1, 2018.

Scope of Service

In the course of conducting defense on civil and/or administrative cases, the lawyer of Legal Aid Service, as the rule conducts following actions:

  • Reviews the information and case materials.
  • Meets with the client and provides legal advice.
  • Analyzes the information related to the case, ensures the collection of evidence and submission with the court for the purpose of successful conduct of the case.
  • Represents the client in court.
  • Drafts legal documents related to the case – motions, claims, counterclaims, motions complaints, applications.
  • Informs the client an in case of necessity his/her legal representative on the course of conduct of the case.
