Natia Berdzenishvili, a lawyer at Mtskheta Legal Aid Bureau, prepared a lawsuit in a labor dispute case and represented citizen R. Sh. in subsequent court proceedings. R.Sh. had worked in various positions at a natural gas supplier for 6 years.
In 2023, while he and his partner were on duty, there was an emergency shutdown in the gas pipeline network. The information reached R. Sh. late because his partner had left his workplace without warning and had taken with him the phones that received notifications about the accident. R. Sh. managed to turn on the gas an hour late, after his partner returned to the workplace.
Due to this fact, he was dismissed from work without being served with a dismissal order. The aforementioned order was served only based on the employee's multiple written requests. Attorney Natia Berdzenishvili filed a lawsuit with the court and demanded to declare the dismissal decision void, reinstate R. Sh. in the same position, and compensate him for the forced dismissal.
Significant witnesses were called to the trial at the defense's request, and proof showed that the business had flagrantly violated the employee's rights. Ultimately, after having determined that the lawsuit prepared by attorney Natia Berdzenishvili was well-founded, the court partially satisfied it. Specifically, the dismissal order was deemed invalid as R. Sh. found another position unacceptable and the position in question was no longer vacant at the time of the decision.
The defendant was ordered to pay compensation in favor of the plaintiff in the amount of 2,000 GEL, and the company was also ordered to pay compulsory compensation from the actual termination of the employment relationship until the execution of the decision.
