With the help of the LAS Samtskhe-Javakheti Bureau public lawyer, Paata Manvelishvili, Dariko Sh. who faced 4 years of restriction of liberty for non-reporting of grave crime, was fully acquitted by the court.
According to the case materials, Dariko Sh. was a witness of the fact that how a gang was discussing the plan of robbery of a person working in money exchange field and then the details of the committed robbery, but she did not report about the fact to the police.
At first, the private lawyer defended the accused, but as he did not appear at the court trials, Dariko Sh. was appointed the public lawyer from Legal Aid Service.
The position of the prosecution was based mainly on the testimonies of the accused persons of robbery. However, while questioning, some of them used right to silence, some of them did not tell anything about Dariko Sh.
In this situation, the lawyer Paata Manvelishvili demanded acquittal for the defendant as there the evidences of the prosecution against Dariko Sh. at the stage of investigation were no proved by the forensic examination.
Finally, Akhaltsikhe District Court shared the position of the defense party and rendered the verdict of acquittal for Dariko Sh.
