With the help of the LAS Shida Kartli Legal Aid Bureau attorney, Maia Grigolishvili, a minor Nino A. was saved from receiving preventive measure.
According to the case materials, on January 15, 2013, in the Gori children’s home of a family type, Nino A. committed battery knowingly against minor Mariam I. which caused a physical pain to her. Nino A., who was already diverted from the criminal case earlier, confessed to the perpetrated action. The prosecution demanded giving her to supervision as a preventive measure.
The public attorney, Maia Grigolishvili opposed using a preventive measure, as it would have effects on the minor’s psychological and mental development. The attorney based her position on the following: the crime was minor, the defendant confessed she was guilty, others characterized her positively, the defendant and the victim both lived in the children’s home and were in a good relationship.
The court discussed the motion of the prosecutor, heard the both parties, analyzed the criminal case materials and as a result did not satisfy the demand of the prosecution regarding appointment of a preventive measure.
