Based on the court's decision, Iamze Memarnishvili, attorney of the Ozurgeti Legal Aid Bureau of the LEPL Legal Aid Service, got involved in the case of L.Ts., a resident of Lanchkhuti.
The father of the minors was arrested at his home by the police and taken to a temporary detention isolation ward. Then an administrative violation protocol was drawn up - under the first part of Article 173, which implies disobedience to the legal order or request of an employee of a law enforcement agency, or verbally insulting this person, and/or carrying out other offensive actions against him (except for the cases provided for by the Criminal Code of Georgia).
At the attorney’s request, the witnesses were questioned during the trial. Following the witness interrogation, lawyer Iamze Memarnishvili requested that the case be terminated, and the detainee released from the aforementioned duty on the grounds that there was no evidence of a legal infraction.
The judge fully shared the position of the public attorney and stopped the proceedings against L.TS. due to the absence of the fact of an administrative offense.
