Iamze A. addressed the LAS Tbilisi Bureau for assistance. She wanted to prepare a lawsuit against the defendant JSC Georgian Railway.
On October 1, 1994, Iamze A. who was traveling from Samtredia to Tbilisi, fell between the carriages of the train moving from Batumi to Tbilisi. As a result of the trauma, the doctors had to amputate her right leg. According to the decision of Samtredia District Court dated February 14, 1997, the lawsuit of Iamze A. was partially satisfied and JSC Georgian Railway was obliged to pay 24.5 GEL monthly to the victim. However, after years, the artificial limb began to wear out, the tumor cells started developing which caused the leg to be amputated for the second time with further treatment. Iamze A. had to cover all expenses which in fact, should have been paid by JSC Georgian Railway.
The LAS Tbilisi Bureau consultant, Levan Tsalugelashvili, studied the case and drafted a lawsuit where he indicated that Iamze A. needed the artificial limb the cost of which was 4500 GEL. Besides this, from 1997 till now, the maintenance paid by JSC Georgian Railway lost its purchasing power. That’s why, on the basis of the information given by National Statistics Agency of Georgia, the maintenance money was calculated and the lawsuit was presented before Tbilisi City Court.
As a result, Iamze A.’s lawsuit was fully satisfied. The defendant JSC Georgian Railway was obliged to pay the cost of artificial limb in an amount of 4500 GEL, the monthly allowance of 70.54 GEL and the money owed by the organization – 1494.14 GEL.
