With the assistance of Tbilisi Bureau public lawyer, Giorgi Mdinaradze, L.Ch. who was searched with charge of using drugs without the medical prescription, was fully equipped by the court.
During the trial on merits, the public lawyer made focus on the circumstance that the prosecution party did not indicate none of the experts who wrote the medical report on drug analysis in the list of the persons to be questioned, on the basis of which, the defense party doubted the medical report and demanded it not to be accepted. The demand of Giorgi Mdinaradze was based on the provision of the first part of Article 78 of the Criminal Procedures Code according to which “a document is valid as evidence if its origin is known and it is authentic. A document or material evidence is admissible if a party is able to question the person as a witness, who obtained, created it and/or it was held before it was presented to the court”.
Basing on the above-mentioned facts, the lawyer Giorgi Mdinaradze demanded acquittal for his defendant. The court fully shared his position and acquitted L.Ch. in the presented charge.
