With Assistance of Public Attorney, the Convict Was Saved from Cancellation of Conditional Sentence

With effort of the LAS Shida Kartli legal aid bureau lawyer, Ioseb Gabaraevi, probationer Vasil B. was saved from annulment of conditional sentence and enforcement of the punishment sentenced by the court verdict.

In 2011, Telavi District Court sentenced Vasil B. to 6 years of imprisonment, out of which he had to serve 2 years in prison and 5 years of conditional sentence. In 2013, on the basis of the Georgian Law on Amnesty, Vasil B.’s sentence was reduced by ¼. At first, Kakheti Probation Bureau carried out supervision and assistance of the convict, but after he changed the place of residence, Shida Kartli Probation Bureau undertook controlling him. With the grounds that, since August, 2014, Vasil B. violated appearance to the Bureau several times and did not fulfill imposed responsibilities, representative of Shida Kartli Probation Bureau demanded cancelation of conditional sentence and enforcement of the punishment according to the court verdict.

The public attorney, Ioseb Gabaraevi, did not agree with the application of the Bureau. The case materials showed that the probationer was honestly carrying out his duties and had never stopped contact with the probation bureau. Moreover, there was no any evidence proving that Vasil B. systematically violated the probation regime or he intentionally avoided appearance to the Bureau. His place of residence was unknown too. Considering all these circumstances, Ioseb Gabaraevi demanded from the court to satisfy the application of the probation officer with amendments in it, to declare search to find Vasil B. and establish his place of residence.

As a result, the court left the conditional sentence for Vasil B. in force and partially satisfied the application of the Bureau. The police was able to find the convict and from 2015, he continued to fulfill his duties.
