With effort of the LAS Kvemo Kartli Bureau lawyer, Ioseb Jamaspishvili, Ramin M.O. was sentenced to 9 years of restriction of liberty for committing a group robbery, was acquitted by the Supreme Court.
Bolnisi District Court found Ramin O. guilty in the presented charge and sentenced him to 9 years of restriction of liberty. The public lawyer, Ioseb Jamaspishvili appealed the decision of the court of first instance in the Appellate Court of Tbilisi though it left the decision of Bolnisi District Court in force. Then Ioseb Jamaspishvili applied to the Supreme Court of Georgia.
In the cassation appeal, Ioseb Jamaspishvili made focus on the circumstances that arrest of Ramin M.O. and investigative actions with his participation were carried out in the manner that the lawyer did not accompany him. Moreover, the criminal case was based only on the testimonies of the policemen and was grounded not on the operative information, but on the confession gained from Ramin M.O. under pressure.
The Supreme Court took into consideration arguments of the public lawyer. Namely, the Court came to the conclusion that the verdict of guilty established against Ramin M.O. was controversial to the decision of the Constitutional Court of Georgia dated January 22, 2015. According to this decision, the norms of the Criminal Procedure Code which envisaged possibility of finding someone guilty on the basis of the indirect testimony were recognized non-constitutional.
Finally, the Supreme Court made amendments to the verdict of Tbilisi Appellate Court and acquitted Ramin M.O. in the presented charge.
