In August 2017, socially vulnerable citizen V.Ch. applied to the LAS Mtskheta-Mtianeti Bureau for legal assistance.
At first, while rendering oral consultation, it turned out that in 2016, a loan agreement was signed between the sister of V.Ch. and the TBC Bank. The mentioned beneficiary was a guarantor of her sister before the bank.
Because of not fulfilling the obligations, the bank sued the client where V.Ch., together with others, was indicated as a respondent and he was banned to sell or dispose of in another way the land registered on his name in the public registry.
In order to provide complete legal assistance for the beneficiary, it was necessary to draft a lawsuit. The lawyer Irina Barbakadze, appealed the ruling of Mtskheta District Court dated June 21, 2017, after that the court made a decision in favor of the beneficiary.
However, representatives of the TBC Bank appealed this decision in the Appellate Court. The court examined the lawsuit but did not satisfy it. The court of the second instance left the decision of Mtskheta District Court in force.
Finally, the socially vulnerable V.Ch. was able to restore the right to property and accordingly, he is still able to dispose of the land plot as desired.
