With effort of the LAS public lawyer, Eldar Gvalia, R.G. who was convicted for committing stealing, was fully acquitted by the Supreme Court.
According to the presented charge, R.G., together with the group of accomplices, secretly took possession of playing box – XBOX with the cost of 910 GEL and sold it to the unknown person for 110 GEL. The received money they distributed among each other.
First Tbilisi City Court, then Tbilisi Appellate Court found R.G. guilty and sentenced him 3 years of imprisonment. The defense lawyer of the convict – Eldar Gvalia appealed the decision of the Appellate Court in the Supreme Court.
In his complaint, the lawyer Eldar Gvalia had the following argument to prove the innocence of the defendant: the prosecution party could not present the set of evidences to the court that could prove the blame of R.G.; there were no witnesses of the crime and the video footage which showed how R.G. took XBOX to the hotel room could not prove the fact of stealing. Moreover, the owner of the hotel found out about the stealing of the playing box after 4-5 days. During these days there were many guests in the hotel and the prosecution did not have any other possible versions of stealing, for example, if the hotel maid stole the playing object.
Finally, the Supreme Court share the position of the lawyer Eldar Gvalia and rendered a verdict of acquittal for R.G.
