Person Sentenced to 20-year Imprisonment, Was Released from Courtroom

The LAS Kutaisi Bureau lawyer, Irakli Shengelia defended interests of the convict S.T. at the court of appeal. The first instance court sentenced S.T. to 20 years of restriction of liberty. He was accused of attempt of premeditated murder towards 2 or more persons and illegal carrying of ammunition.

“At the court of appeal, the prosecution could not ground its position that the verdict of the first instance court is lawful and grounded. The prosecutor could not present enough evidences to prove that S.T. committed the crime. In its closing speech, the defense party made focus on the 22 January, 2015 decision of the Constitutional Court as in the present case, the prosecution based its position on indirect evidences and according to this decision, the indirect evidence was found non-constitutional. Only indirect evidence cannot become bases for finding a person guilty if there is not asset of related, reliable evidences in the case that is enough to find someone guilty,” – states the lawyer Irakli Shengelia.

Finally, the lawyer demanded to find the defendant not guilty and to render the verdict of acquittal towards him. The court fully shared the position of Irakli Shengelia, found S.T. not guilty and released him from the courtroom.
