With Assistance of Consultant Natia Berdzenishvili, Citizen Could Receive His Own Salary

With effort of the LAS Mtskheta-Mtianeti Legal Aid Bureau attorney, Natia Berdzenishvili Teimuraz K. who could not receive his own salary and business trip expenses for years was able to win the dispute with his employer.

The citizen Teimuraz K. who worked as a driver for Tavazi Ltd in 2006-2012, addressed Mtskheta-Mtianeti Bureau for assistance. According to him, in August, September and October of 2009, the employer sent him to Kazreti, to do a physical work at gold ore. His salary should have been 700 GEL, but, despite making promise to pay, Tavazi Ltd reimbursed him neither his 3-month salary, nor part of the salary of other months which constituted 566 GEL.

From the start, the Bureau consultant, Natia Berdzenishvili drafted application for Teimuraz K. demanding payment of his salary from Tavazi Ltd. However, the employer did not react on it. Then Natia Berdzenishvili drafted a suit against the company which Teimuraz K. submitted to Mtskheta District Court.

Tavazi Ltd presented its counter suit to the court where they stated that Teimuraz K. did the work only connected with transportation of the goods and he did not carry out any physical work. Besides, Tavazi Ltd explained that the agreement of transportation was signed with the individual entrepreneur, so the latter was responsible to pay the salary and the travel expenses to the driver.  The company was ready to pay only 566 Gel to Teimuraz K. and agreed to reimburse the money step by step.

During the trial, the documents proving payment of Teimuraz K. were not presented. Moreover, it became clear that the agreement of transportation between Tavazi Ltd and the individual entrepreneur was concluded without consent of Teimuraz K. That’s why the court found the agreement null and void.

Finally, the lawsuit of Teimuraz K. was satisfied. The travel expenses were calculated basing on the travel receipts and by the court decision, Tavazi Ltd was imposed to pay 1516 GEL in total to Teimuraz K.
