Mother of Missing Soldier Won Dispute with the State Service of Veterans Affair

Anna B. who wanted to acquire the status of the member of a missing soldier of the war for restoration of the territorial unity of the country and on this basis to receive the monthly state compensation of 1000 GEL, applied to the LAS Tbilisi Bureau for assistance.

The Son of Anna B. was lost while the war hostilities in Abkhazia. In 2014, the court decided to recognize the missing soldier as deceased. The date of death was indicated October 1, 1993, the place – Abkhazia.

This was the judgment of the court that the State Service of Veterans Affairs based on their decision and refused to satisfy the application of Anna B. and grant her the status of the member of the family of the missing soldier. The main reason for the refusal was the fact that according to the court decision the death date of Anna B.’s son was indicated October 1, 1993 when the war hostilities were over in Abkhazia and the Georgian military units were withdrawn from the territory of Abkhazia.

The lawyer of the LAS Tbilisi Bureau, Vladimer Gamrekelashvili drafted a lawsuit and demanded from Tbilisi City Court to annul the old administrative acts regarding Anna B. and make a new decision to grant Anna B. the status she wanted to acquire.

The administrative chamber of Tbilisi City Court fully satisfied the lawsuit. If the second party does not appeal this decision in the court of higher instance then Anna B. will receive the state compensation in an amount of 1000 GEL.
