Person with the IDP Status Won Dispute with the Ministry of Economy and the Administration of the President

With an effort of the LAS Tbilisi Bureau lawyer, Abel Gegia, Kordiko S., an IDP from Abkhazia, could won the dispute with the Ministry of Economy and the Administration of the President at the court of the first instance. The case was regarding the granting residential space.

Kordiko S. applied to Legal Aid Service for a help after she had received the refusal on granting residential space from the Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia. The ground of the refusal was the agreement between Kordiko S. and her son Malkhaz G. according to which both would be granted the residential apartment.

The lawyer Abel Gegia examined details of the case applied to the City Court of Tbilisi with a lawsuit demanding to: 1. recognize partially invalid the purchase agreement between Malkhaz G. and the Ministry of Economy in the part of granting the residential space to Kordiko S. 2. annul the Decree N62 of the President of Georgia dated February 2, 2009, in the part of granting the residential space to Kordiko S. in the form of direct selling. 

At the stage of examining the case at the court, the Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia got involved in the case as a third party. The court did not recognize the lawsuit of the defendant and the third party and explained that the lawsuit was ungrounded and out of date.

Finally, Tbilisi City Court fully satisfied the lawsuit drafted by the lawyer Abel Gegia. If this court decision enters into force, Kordiko S. will gain the right to demand from the Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia to grant her a residential space.
