With Assistance of Contracted Public Lawyer, Person Accused of Robbery and Attempt of Rape Was Acquitted

With effort of the contracted public lawyer, Besik Talakhadze Davit K. who was accused of committing premeditated robbery by a group and attempt of rape was fully acquitted by Tbilisi City Court.

Davit K. was charged with committing crime envisaged by paragraph B of the second part of article 179 and the first part of article 19,137 of Criminal Code of Georgia. Namely, Davit K. was accused of the fact that, on July 6, 2015, he together with Bachuki T. broke into the shop of the second hand clothing located in Tevdore Mghvdeli Street N8, in Tbilisi, in order to take illegal possession of various objects. According to the charge, Davit K. had an attempt to make sexual intercourse with the shop assistant, Natia B. through violence but was not able to fulfill his wish because of the resistance of the woman. Basing on the case materials, Davit K. and Bachuki T. seized the wallet of Natia B., with money in it and her identification card, her mobile phone, shorts, T-shirt and trainers.

The lawyer, Besik Talakhadze said in his closing speech that there was the only direct evidence in the case – testimony of the victim that was not sufficient to render verdict of guilty necessary for the standard of existing evidence beyond the doubt.

While studying the material evidences, the defense party revealed violations. In particular, that the robbed objects were placed in a damaged bag. This fact created doubt regarding authenticity and change of the objects. The lawyer, Besik Talakhadze, in the closing speech, demanded that the above-mentioned objects should not be accepted on the basis of the second part of article 72 and the first part of article 79 of Criminal Procedure code of Georgia.

Tbilisi City Court shared the arguments of the lawyer, Besik Talakhadze, delivered a verdict of acquittal towards Davit K. and released him from the court room.
