With Assistance of the Consultant Tinatin Diakonashvili, Citizens Could Win Property Dispute

With assistance of the LAS Samtskhe-Javakheti Bureau consultant, Tinatin Diakonashvili, the citizens Natela G. and Irma G. could win the dispute regarding the property.

The sisters – Natela G. and Irma G. legally owned 1/8 part of the house situated in Chitakhevi village, Borjomi district. The extra 1/8 part of the house was the property inherited from their grandmother. In 2010, their neighbor Ksenia B. misappropriated and registered in her name the property on the basis of the incorrectly drafted cadastral drawing and incomplete document establishing the right on the house.

After this, Ksenia B. asked her son-in-law to buy the misappropriated property with the guarantee for her grandchildren. In 2014, after one of the grandchildren died, the property was inherited to the parents of Ksenia B.’s grandchildren.

After Natela G. addressed the LAS Samtskhe-Javakheti Bureau, the consultant Tinatin Diakonashvili started working on the case. She carefully studied the documents related to the case which showed the fact of misappropriation. Moreover, Tinatin Diakonashvili found the decision on the disputed property made by the Supreme Court in 1992 according to which the demand of the grandmother of Natela G. and Irma G. regarding the expulsion of her neighbor Ksenia B. from her living accommodation was satisfied.

The consultant Tinatin Diakonashvili drafted the lawsuit in which Natela G. addressed the court and demanded: to annul the cadastral drawing and the purchase agreement signed between Ksenia B. and her grandchildren.

Finally, Akhaltsikhe regional court fully satisfied the lawsuit prepared by Tinatin Diakonashvili. This gave the opportunity to Natela G. and Irma G. to have legal ground to register the disputed house in their property.
