With Assistance of the Lawyer Davit Gogvadze, Punishment for a Person under 21 Was Mitigated

With assistance of the LAS Adjara Bureau lawyer, Davit Gogvadze, the punishment for Temur K. who had conviction for destroying and stealing of other person’s object was mitigated.

The criminal prosecution against Temur K. had started on the basis of several charges. At first, he was accused of damaging one of the cars which belonged to the state agency and the cost of the damage was 250 GEL. The criminal proceedings were not finished when Temur K. committed one more crime. Namely, he stole one of the expensive drinks from the shop.

Temur K. was given 2 years of conditional sentence on the case of damaging the car. At the same time, the case regarding stealing alcoholic drink was in process. However, being under conditional sentence, Temur K. still committed another crime – he stole alcoholic drink again.

It is worth to mention that taking into consideration the juvenile justice standards Temur K. was sentenced with the bail for the first two offenses, regarding the third offense – the bail on security of imprisonment. Moreover, the defendant failed to pay for his bail for each case.

Temur K. as a person under 21 was subject of compulsory defense, that’s why, the LAS Adjara Bureau lawyer, Davit Gogvadze was appointed for him.

The lawyer Davit Gogvadze appealed the decision on the case of damaging the car which envisaged 2 years of conditional sentence. He demanded from the appellate court to sentence Temur K. with a fine in the amount of 500 GEL. The Court of Appeal partially satisfied the demand of the defense party, cancelled the conditional sentence and charged Temur K. to pay the fine of 700 GEL.

After this, the lawyer Davit Gogvadze demanded to unite the cases of stealing and it was satisfied. Finally, on the basis of the plea bargaining, Temur K. was sentenced restriction of liberty for 2 years and 3 months – 3 months of imprisonment and 2 years of conditional sentence.
