Zugdidi Bureau Success

Members of a family displaced from Abkhazia applied to the Zugdidi Legal Aid Bureau to receive legal advice and draft  a legal document. The family consists of a mother, father, and a minor child.

The parents sought  to divide the land plot in a village in Zugdidi Municipality, transferred to them by the state, and to register it in the Public Registry. 
 At the same time, the mother and the small kid would share ownership of the divided land.

However, citing a minor's interests, the LEPL National Agency of Public Registry denied the family's request to divide the land plot. Zugdidi Legal Aid Bureau attorney Natia Kvartskhava draughted an application and submitted it to the National Agency of Public Registry.

The complaint stated that according to Article 183, Part 2 of the Civil Code of Georgia: The disposal of immovable property owned by a child by his/her parent or other legal representative is permitted in accordance with the best interests of the child, based on the consent of the court. The lawyer substantiated with various legal acts and the factual situation that the division of the land plot did not violate the best interests of the child and there were no legal obstacles to the registration of the immovable property.

Finally, the National Agency of the Public Registry of Georgia  upheld the complaint, declared the previous decisions of the Public Registry invalid, resumed the proceedings, and satisfied the request of the displaced family to register ownership rights based on the division of the land plot.
